Department of Justice Wants to Change ADA Rules

ALERT – Your comments are urgently needed!

The Department of Justice has proposed changes for two parts of the Americans with Disabilities Act (ADA): Title II (state and local government programs and services); and Title III (public accommodations; businesses). New rules will affect your rights.

Comments due by August 18, 2008.

The NAD is preparing comprehensive comments to file with the Department of Justice. The NAD also needs you to file comments with the Department of Justice.

The NAD participated in preparing sample comments that are available now at www.dredf.org/DOJ_NPRM. See especially the section on “Communications.”

This website also has instructions on “How to File Your Comments” with links to filing comments electronically on the Internet, and “Tips on Commenting.” Add your thoughts and your personal experiences to the sample comments for the most impact.

When you agree with a new rule, thank the Department of Justice. It is important to support good new rules against attack from government agencies and businesses.

When you disagree with a new rule, tell the Department of Justice. There are many changes that would reduce your rights.

Time is short. Pick and send comments on the topics that interest you the most.

    Would you kindly care to expand more details on “proposed changes” by the U.S. DOJ for the Title II and III of the ADA law?

    What kind of changes the U.S. DOJ want to change?

    I disagreed with Department of Justice! They need to leave 2008 ADA laws alone and let US Senates make compromises until final agreements. DOJ proposed some too unimportant stuff for now. Worry about it later. It is not fair for any Disabilities people. Department of Justice NEVER recommend about how to improve unemployment rate under United States on any disabilities. They sort of created lot of distractions and loopholes from important issues for disability’s rights.

    It is time to improve the ADA for any Disabilities to gain their rights to access any employee companies even Federal and States jobs!

    The “proposed changes” are listed on the Disability Rights Education & Defense Fund (DREDF) website at http://www.dredf.org/DOJ_NPRM, along with the sample comments in response to these proposed changes.

    The website also has links to the Department of Justice Notice of Proposed Rulemaking and related documents, which are hundreds of pages long. You can also find these documents at http://www.ada.gov.

    The proposed changes include things like adding, defining, and providing some guidance for “Video Interpreting Services,” and asking about captioning at stadiums and in movie theaters.

    You are correct about the timing. A lot of things are happening now. The Department of Justice wants to issue new rules for some parts of the ADA — Title II (for state and local government programs and services) and Title III (for public accommodations; businesses) — but not for Title I (for employers). The Equal Employment Opportunity Commission (EEOC) issues rules about Title I (for employers). At the same time, Congress is considering making changes to the ADA law — about the definition of “disability” — about people who are covered by the ADA. If Congress passes the ADA law amendments, both the Department of Justice and the EEOC will need to issue new rules about who is covered by the ADA.

    Thanks for responding my message. I am watching 2008 ADA Amendment closely under US Senate.

    To be honest, how’s US Senates handle 2008 ADA Amendment so far? I heard President George Bush may veto it because he is afraid to create too much litigation after 2008 ADA passed, is that true?

    Fighting for access is one thing. However it’s useless these times to be fighting for access. Our group homes for the deaf eliminate the need for fighting for access as were PROVIDING the access. We’ll be replicating this all over the globe.

    If they want access, they can live in our group homes and they need not be worrying about fighting for it.

    Senate support for the “ADA Amendments Act of 2008″ continues to grow. I know at least another 8 Senators signed on as co-sponsors, bringing the total to 65 co-sponsors. See

    I don’t know what President Bush plans to do, but hope he will support the ADA Amendments, like his father supported the ADA.

    WE need to have ADA for the disability because of the Languages we need to have a lot of supporting from Advocate not very many HEARING people espeically the presidents who is not familiar the languages and ASL because of the reading and who is not able to understand the english written and we do need the ADA for our rights!! I m deaf!!! WE CAN NOT ingored this to supporting the DEAF and Hard of hearing and Late deafness and Deaf /blind.. Ellen Rice Deaf in GA.

    They really should be looking at redefining who is “disabled” and who is not. I know its a slippery slope but there are just too many people getting SSI. People who are depressed or nervous can get it and I have spinabifida and I am PAYING IN to SSI.

    Why is it always hard for us people with disabilities and sooooo easy for hearing people.Everything is at their fingertips and they dont even have to ask for it…. But let us ask, and then there are barriers…. Why qqqqq We are tax payers as well…we pay our percentage….Please dont make it so hard on us…. Let us enjoy the rights the hearing people have. Soooo convenient!!!! Please….

    Why is it so hard for us people with diabilities. qqqq The hering people ask and they get what they want right away… But let us ask, and then we face barriers… We are tax payers too…We do our share…. Please do not make it so hard on us… Let us enjoy the amneties that hearing people have as well….Thanks….

    Why we have to pull every dirty barrier, discrimination, trails leftover from hearies???? We never betrayed them nor hurted them at all.

    I AM DEAF WOMAN AND I HAVE LOW VISON OF EYE SO I WATCH TV NEWS WITH CLOSED CAPTIONED ON CHANNEL (ANY) FOR MY LUNCH TIME DURING MY WORK, SO FEW CO WORKERS FOR ANOTHER (HEARING) HARRASSED INTERUPPTED ME NOT EXCUSE ME TO TO MOVE TV MOVE TURN AND CLICK SOUND HIGH SO I CAN’T READ CLOSED CAPTIONED TO CONFLICT TO SOUND HIGH LINE, SO I WAS SO DISGUST AND VERY UPSET THAT THEY WERE SO RUDE TO ME NOT EXCUSE ME WITHOUT COMMUNICATION TO INGORE ME TO FOLLOW ME TO BOTHER ME, SO I WAS VERY FRUSTRATED SO WHAT I SHOULD GET FILE COMPLANT AGAINST THEM BECAUSE THEY BOTHER ME TO INTERPUTTED ME TO SOUND HIGH TV INGORE ME WHEN I CAN’T READ CLOSED CAPTIONED TO CONFLICT SOUND HIGH LINE, SO THEY ARE VERY WRONG SO WHEN SO I WATCH READ CLOSED CAPTIONED TV WITH LOCAL NEWS AND OTHEERS THAT THEY SHOULD RESPECT ME TO EXCUSE ME COMMUNICATION AFTER I FINISHED WATCH TV CLOSED CAPTIONED NEWS OR ANY PROGRAMS FOR ANY PROGRAMS, SO YES THEY ARE DISCRIMATION ME BECAUSE I AM DEAF WOMAN AND LOW VISON EYE PROBLEMS SO I ALWAYS TURN MOVE LEFT SODE TV WHEN I WATCH CLOSED CAPTIONED TV NEWS SO I CAN ENJOYED WATCHING TV WITH CLOSED CAPTIONED FOR MY LUNCH TIME DURING MY WORK AND I WANT TO RELAX TO WATCH TV CLOSED CAPTIONED FOR MY LUNCH DURING MY WORK.     After I graduate from the college in 2005, I am not able to find a job. I submitted all my resumes in the website such as Monster.com, USAJOBS.GOV, Careerbuilder.com, and etc. They contacted me and they found out that I’m Deaf. They never called me again. Some of them said “We don’t have an equipment for Deaf.” They hung up on me. During 3 years now, I feel like I am hopeless. I still have SSI which I do NOT want it but I dont have any choice to keep the SSI. I am not able to buy a new car, I still have a student loan, and I am not able to buy a dream home. I need the ADA to improve about hiring Deaf/HOH for jobs!!!!!

    Ms Daniels,

    You can put down on your email without relay service and you can put down email address only in resumes.
    You can give NAD employment. They are actually discriminated you for.
    You can go to Vocational Reb. I know how you feel the similiar as mine. but I already got a job who want to interview without no problem without relay service. It is hassle.

    I’m not familar with ADA law cuz I grew up hearing world but I’m deaf myself and I work for Federal Gov’t for almost 24 years and my understanding that I have seen hearing people pick hearing people favoritism on one person or group over deaf peoples and it’s not fair!
