“ADA Restoration Act of 2007” becomes “ADA Amendments Act of 2008”
Last year, in June 2007, the “ADA Restoration Act of 2007” (H.R. 3195 / S. 1881) was introduced in Congress to “restore” the ADA. The focus of the restoration is on the definition of who is an “individual with a disability.” The U.S. Supreme Court limited the definition in 1999. The ADA Restoration Act wants the determination of whether an individual has a disability to be made “without regard to mitigating measures,” such as hearing aids or cochlear implants, that an individual may use. Restoring the definition will help ensure that individuals who use hearing aids or cochlear implants qualify for protection under the ADA and obtain reasonable accommodations.
Over the last few months, the NAD has been participating in discussions with disability groups and business organizations to move this bill forward and get it passed quickly. On June 25, 2008, the “ADA Amendments Act of 2008” was introduced as a replacement for the original H.R. 3195. The new bill has the same goals as the “ADA Restoration Act of 2007.” The “ADA Amendments Act of 2008” was quickly passed by the House of Representatives with a vote of 402 to 17. We are working to build the same kind of overwhelming support in the Senate.
Yesterday, the NAD signed on to a letter which will be sent to the Senate next week. The letter asks the Senate to take action and pass the “ADA Amendments Act of 2008” quickly.
We have also asked every state association to sign on to the Senate letter to show support for the “ADA Amendments Act of 2008.”
